Privacy Policy

This Privacy Policy describes how Hiba collects and uses the personal information you provide on our Website www.hiba.org. It also describes the choices available to you regarding our use of your personal information and how you can access and update this information.

1.    No sale of personal information 

Hiba will not rent or sell your personal information to third parties.

2.    Information you provide through the account creation and update process is always confidential

  • When you create an account on the Website, we collect basic information about you through the registration process – such as your name, email address, and a means to authenticate your account (for example, a password).

  • You can review and update your supporter account information you provide to Hiba through the Website by logging into your account on the Website.

4.    Disclosure of information collected and displayed about the Funds that you have contributed (“Fund Transactions”) depends on your supporter profile setting 

Hiba collects information on your Fund Transactions, individually (for example, amount of a Fund Transaction, recipient of a Fund, Fund location, Fund status) and in the aggregate (for example, number of Fund Transactions and the distribution of Fund Transactions by gender, country, business sector and field partner). If you have created an account on the Website and conducted Fund Transactions through your account, Hiba makes information on these Fund Transactions available to you on your private portfolio page on the Website. Hiba will not disclose your personally identifiable Fund Transaction information to any third party without your consent. Hiba may further publicly display and disclose Fund Transaction information, either in a personally identifiable or anonymous manner, for example, as part of the current activity on the Website and as part of a historical visualization of activity on the Website. If you have created an account on the Website and conducted Fund Transactions through your account, you can review information for these Fund Transactions by logging into your account on the Website. 

5.    Information collected, displayed and used for other Website and Program features. 

As you use additional features on the Website or otherwise participate in the Program, we may collect any additional information you choose to provide in order to facilitate the operation of these features on the Website or your participation in the Program. For example:

a.    Comments and messages.  If you use interactive features on the Website to write a comment (for example, on a Hiba blog, Facebook wall, message board or volunteer forum), Hiba will collect your name and your comment, and optionally, your location and Hiba may publicly display this information. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, please contact us.  In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

b.    Integrated third party features.  If you use features on the Website that are integrated with third party websites or services (for example, Mail Chimp, Twitter and Facebook) to share information about your activity on the Website (for example, information about recently completed Fund Transactions and whether you “like” Hiba) through the third party website or service, Hiba will share this information with the third party website or service and additional information, if any, that you choose to provide to Hiba in order to use these features (for example, your username for the third party website or service). However, Hiba reserves the right to withhold or withdraw information related to Strivers to the extent necessary to protect the privacy of Strivers. If you use interactive features on Hiba to indicate that you "recommend" a particular feature or listing on Hiba, that information will be collected and may be displayed on the Website and furthermore shared on any applicable third party websites and services to which you have authorized such information sharing.

c.     Donations.  Hiba collects information on any donations you make to Hiba (whether through the Website or offline) to communicate with you (for example, to provide funding confirmations) via your email address or through other means of contact that you have chosen to provide to Hiba.

d.    Customer service.  If you contact Hiba customer service, we will collect the information you provide (for example, your name, email address, physical address, phone number and question/comment) in order to contact you and address your question or comment.

e.    Applications.  If you submit an application to Hiba (for example, to be an employee, volunteer or field partner), we collect the information you submit (for example, name, phone number, resume, cover letter and position of interest) to assess the application and follow up with you on such submission.                        

f.    Surveys and Promotions. From time-to-time, Hiba may provide you the opportunity to participate in promotions or surveys through the Website or through email. If you participate, we may request certain personally identifiable information from you. Participation in these surveys or promotions is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and shipping address), and demographic information (such as zip code and gender). We use this information to notify and award promotion winners, to monitor Website traffic, personalize the Website and Program and to send participants email newsletters. We may use third party service providers to conduct these surveys or promotions. We will not share the personally identifiable information you provide through a contest or survey with other third parties unless we give you prior notice and choice.

6.    Information from third parties are carefully monitored 

Hiba collects your information from third parties to facilitate activities and transactions for the operation of the Website and Program, improve User experiences on the Website and in the Program and further Hiba’s mission.  Examples of information we receive from other sources include information from another User about whether you referred that User to Hiba, information from service providers about your use of the Website. Where available, you can import contacts from your Gmail, Yahoo! or other email account address book to invite them to become members of our site. We or our service providers collect the username and password for the email account from which you wish to import your contacts and we will only use it for that purpose.

7.    Information will be gathered from cookies and web beacons to improve the website

A cookie is a text file containing a small amount of data which is downloaded to your computer when you visit Hiba’s Website or see one of our adverts elsewhere on the internet.  The vast majority of websites use cookies and tracking technologies. Cookies are useful because they help us arrange the content and layout of our websites and recognize those computers that have been to our websites before. They allow us to remember your preference settings and play an important role in helping us to enhance the usability and performance of our websites and your experience using them.  Some cookies are also essential to enable you to move around our website and use its features. They also help us to identify which of our articles are the most popular and the types of journey visitors have to and on our Website.

Similar to many websites, if you have enabled cookies in your browser, Hiba, independently and through enabled third party tools and programs, collects certain technical information using cookies, such as the path of users to the Website, pages visited, originating IP address, browser type, browser language and the date and time of the user's visit. Currently, Hiba’s Website is not using cookies but may be introduced in the future for the aforementioned purposes. In that case, if you have disabled cookies, the Website may not work as it is intended because Hiba will use cookies when you sign in to keep track of your personal session.

The use of cookies by third parties on the Website is for the purpose of making the Website easier to use and to enable certain features of the Website and is not covered by this Privacy Policy. We do not have control over these cookies.

8.    Electronic communications are the main medium of contact

From time to time you will receive disclosures, notices, documents and information based on your account information, status or activity (collectively, "Communications") from Hiba (for example, confirmations of Funds you have made, confirmation receipts for donations you have made, statements or other information with respect to the amount of credit available in your Hiba account, confirmation of email address or password changes, or customer service inquiries regarding the status of or activity in your account). By creating an account with Hiba on the Website, you agree that all Communications from Hiba relating to your use of the Website and participation in the Program may be provided or made available to you electronically by e-mail or at the Website. To access the Communications electronically, you will need to use a computer with Internet Explorer 8.0 or above, Chrome 4.0 or above, Safari 4.0 or above, Opera 10.0 or above or Firefox internet browsers and with hardware capable of running these internet browsers. You may withdraw your consent to receive Communications electronically by contacting Hiba in the manner described below. However, if you withdraw your consent to receive Communications electronically from Hiba (other than for the optional emails described in Section 9 (Optional emails) below), Hiba will not have the ability to permit you to fund any additional Funds through your account on the Website. The withdrawal of your consent will not affect the legal validity and enforceability of electronic Communications provided by or on behalf of us in connection with any of your Funds that have not been fully repaid, or any electronic Communications provided by or on behalf of Hiba prior to the time you withdraw your consent. It is your responsibility to keep Hiba informed of any changes in your email address so that you continue to receive all Communications without interruption. By registering on the Website, you acknowledge that you can access the electronic Communications, and you consent to having all Communications provided or made available to you in electronic form and to participate in the Program electronically. We may also provide you with Communications through physical mail at our full discretion.

9.    Optional emails can be selected 

By default, you will receive the following types of emails from Hiba, but you can choose not to receive these emails through a preference on the My Account, Email Preferences section of the Website or in the email: Fund repayment notifications, Hiba news and Fund updates. Hiba will not disclose your email address to our field partners, strivers or supporters in any case.

10.  Disclosure to affiliates, service providers, agents and representatives will only be undertaken where necessary 

We will disclose your personal information with third parties only in the ways that are described in this privacy statement. Hiba's affiliates and service providers, agents and representatives of Hiba and its affiliates may be provided access to your personally identifiable information as part of, or incident to, their provision of services to Hiba (for example, processing Fund transactions and distributing Hiba emails). All such access shall be under appropriate confidentiality agreements and limited to use to provide services to Hiba to help Hiba further its mission.

11.  Hiba reserves the right to disclosure of non-personally identifiable data 

Hiba reserves the right to disclose information that does not directly identify you, for example, aggregated or anonymized data, for educational, informational or promotional purposes in furtherance of Hiba’s mission.   

12.  Hiba may make legal disclosures 

Notwithstanding anything to the contrary in this Privacy Policy or the Terms of Use, you acknowledge, consent and agree that Hiba may disclose information in order to: (a) comply with applicable law, regulation, legal process, or governmental request; (b) protect the rights, property and safety of Hiba, Users and others, including intellectual property rights; and (c) enforce or apply our agreements and policies.

13.  Additional uses of your information 

In addition to the uses (including display and disclosure) of your information that we have described above in this Privacy Policy, Hiba uses your information that Hiba has collected as described above in this Privacy Policy in order to facilitate activities and transactions for the operation of the Website and Program, improve User experiences on the Website and in the Program (for example, to personalize the content provided to you on the Website and to enhance connections between supporters and between supporters and strivers) and further Hiba’s mission. With your consent we may post a short profile along with your name in the Meet the Fellows area of the Website. If you want your profile removed please contact us.

14.  You will always maintain access to your information 

If your personally identifiable information changes, you may correct, update, amend, delete/remove your information by making the change on the My Portfolio, Profile section of the Website or by requesting the change by contacting Hiba by email at info@hiba.org at the contact information listed in Section 22 (How to contact Hiba) below. We will respond to your change request within 30 days. You may terminate your participation in the Program and registered account on the Website at any time and for any reason by sending a written notice of termination to Hiba along with instructions for the disposition of your then-available Hiba Credit and any additional credits that you may receive in the future (e.g., based on repayments of then-outstanding and active Funds), such notice to be effective within two (2) weeks of receipt by Hiba.

15.  Other linked websites are subject to their own privacy policies and Terms of Use

If you follow any links which remove you from the Website (PayPal, Facebook, Twitter, Blogger, Wordpress), this Privacy Policy no longer applies – i.e., the privacy policies and practices of other websites and other parties are governed by their respective Terms of Use and privacy policies. Please note that electronic payment processing for (i) additions of funds into a Hiba account or (ii) withdrawal of funds from a Hiba account is provided by the third-party payment processing provider, PayPal.

16. Public Forums. 

Our Website offers publicly accessible blogs. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us at info@hiba.org.  In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

17.  Note regarding children under 13

The Website is intended to be used by adults. It is not intended for children, and Hiba does not want to collect any personal information for persons who are under the age of 13. Hiba recommends that parents do not post, or permit others to post, any personally identifiable information with respect to persons under the age of 13. If you believe that we have any information from a child under age 13, please contact us at info@hiba.org.

18.  Security

Hiba takes reasonable steps to maintain appropriate physical, technical such as encrypting transmission of information using SSL and administrative security to help prevent loss, misuse and unauthorized access, disclosure and modification of personal information.  While we take these reasonable efforts to safeguard your personal information, no system or transmission of data over the Internet or any other public network can be guaranteed to be 100% secure. 

19.  Location of data

Hiba is headquartered in the USA. Your personal information may be accessed by Hiba, our affiliates, service providers, agents and representatives in the USA or elsewhere in the world.  By providing us with personal information, you consent to this transfer. Hiba will protect the privacy and security of personal information according to this Privacy Policy regardless of where the personal information is processed or stored.

20.  Retention period  

Hiba reserves the right to retain your personal information for a period of seven years or more to satisfy legal requirements such as recordkeeping and tax and credit reporting requirements, as well as for purposes of fraud prevention, audit and data integrity. In addition, Hiba reserves the right to retain, as well as to use and disclose as permitted pursuant to this Privacy Policy, your personal information for such period of time as reasonably needed by Hiba to facilitate activities and transactions for the operation of the Website and Program, improve User experiences on the Website and in the Program and further Hiba’s mission. Hiba reserves the right to retain information that does not directly identify you, for example, aggregated or anonymized data.

21.  This Privacy Policy may be modified; Interpretation

Hiba may update or modify this Privacy Policy from time to time. If any changes are made, Hiba will reflect the date on which any such changes are made and posted by updating the "last updated" date at the top of the page. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this Website prior to the change becoming effective. Please be sure to check this page periodically for changes. Capitalized terms used but not defined in this Privacy Policy have the meanings set forth in the Terms of Use..
